[ARCHIVED] Glen Head Man Convicted of DWI Despite Refusing a Breath Test

Kevin Kralick was driving twice the speed limit and failed to maintain his lane

MINEOLA, N.Y. – Nassau County District Attorney Madeline Singas announced that a jury found a Glen Head man guilty of Driving While Intoxicated for a March 2016 incident in which he was driving 60 miles an hour in a 30 mile per hour zone.

Kevin Kralick, 37, was found guilty yesterday of Operating a Motor Vehicle While Intoxicated (an E felony). The trial before Judge Howard Sturim lasted nine days and the jury deliberated for approximately 40 minutes. The defendant is due back in court for sentencing on September 25 and faces 1-1/3 to four years in prison.

“This defendant endangered every driver and pedestrian when he drove drunk through Roslyn swerving out of his lane at twice the legal speed limit,” DA Singas said. “I thank the jury for their service, and I am grateful to the Nassau County Police Department and our prosecutors for their work on this case.”

DA Singas said on March 23, 2016 the defendant was driving northbound on Bryant Avenue in Roslyn heights when Nassau County police officers noticed he was failing to maintain his lane and driving 60 MPH in a 30 MPH zone. Police officers also observed the defendant’s vehicle, a grey 2013 Subaru, crossing into oncoming traffic, repeatedly swerving over the double yellow line. After being pulled over, officers observed the defendant to be intoxicated. They observed him to be swaying while standing, detected the strong smell of alcohol on his breath and observed him to have glassy eyes and slurred speech.

The defendant was arrested after refusing a preliminary breath test on the scene. He refused a second breath test at police headquarters while in custody.

Assistant District Attorneys Stefanie Palma and Alexander DePalo of DA Singas’ Vehicular Crimes Bureau are prosecuting this case. Kralick is represented by Kevin Kearon, Esq.
